Terms of Use

1. Scope & Provider

These Terms govern the use of Burnmaxxing (burnmaxxing.com, the „Platform“), operated by Balane GmbH, Balanstraße 84, 81541 Munich, Germany (the „Provider“). By registering or using the Platform you agree to these Terms.

2. Description of the Service

Burnmaxxing is a humorous entertainment service about AI spending. It shows statistics, leaderboards, share cards and a community „Furnace“ feature. It is not a financial, accounting or advisory service.

So-called „verified“ figures are taken — where technically possible — from the respective providers' APIs (e.g. OpenAI, Anthropic). We make no warranty as to their accuracy, completeness or timeliness; the respective provider's billing is authoritative.

3. User Account

Registration is via GitHub (OAuth). You are responsible for keeping your access confidential. One account per person. Only your chosen pseudonym is shown in public.

4. User Content (Furnace)

In the „Furnace“ you may submit content (ideas, descriptions, linked repos) and vote on submissions. You remain responsible for your content and warrant that it infringes no third-party rights and is not unlawful, offensive, discriminatory or abusive.

You grant the Provider a non-exclusive, royalty-free, worldwide right to store, display and distribute your submitted content within the Platform. We may remove content that violates these Terms or applicable law without prior notice.

5. Cosmetic Purchases („Burn Direct“)

Optional packs are purely cosmetic (e.g. flair, badges, share-card themes) and have no monetary value. They do not alter the verified figures. There is no claim to the permanent availability of any cosmetic item.

Payments are processed by Lemon Squeezy (as Merchant of Record); their terms additionally apply.

Right of withdrawal: For paid digital content you as a consumer generally have a 14-day right of withdrawal. This lapses if, before the period ends, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal upon completion.

6. Availability

The Platform is provided on a best-effort basis. No particular level of availability is owed; outages due to maintenance or faults may occur.

7. Liability

We are liable without limitation for intent and gross negligence and for damages arising from injury to life, body or health. For slight negligence we are liable only for the breach of a material contractual obligation (cardinal obligation) whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely; in that case liability is limited to the foreseeable damage typical of the contract. Any further liability is excluded. Liability under the German Product Liability Act remains unaffected.

Your own API keys & provider accounts: If you connect your own API key or provider account (e.g. Anthropic, OpenAI), you do so at your own risk. Unless expressly agreed otherwise, the key is used only once to read your usage and cost figures and is then discarded. Subject to the mandatory heads of liability above, we accept no liability for any costs, fees, rate limits, suspensions, data loss or other damage arising from the use, compromise or malfunction of the key or account you connect. You are responsible for using keys with an appropriate scope and for revoking them with your provider.

8. Termination & Deletion

You can delete your account at any time without giving reasons (or request deletion via contact@balane.tech). We may suspend or delete accounts that violate these Terms.

9. Changes to these Terms

We may amend these Terms with effect for the future and will notify you of material changes in an appropriate manner. The version currently in force applies.

10. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of your country of residence remain unaffected. Should individual provisions be invalid, the remainder stays in force.
